What a man feels when his execution is near – CBS News

“[There was] a doctor and a bunch of guards,” Jamison tells A&E True Crime. “The doctor checks your vitals, and the guards ask you what you want for your last meal. Then they ask you where they can send the body to.”

The doctor “was real professional about it,” Jamison says. “He was just doing his job.”

The guards were crying. “Some of them get to know you. And they like you,” he explains. “They knew me personally. They liked to keep me alive.”

I was shocked when I discovered KC had been given an execution date. He asked if I would go to watch, and I said I would. Several of us visited him during the three days leading up to his death, and I was close to tears for much of that time.

It has also broadened my mind. I have come to mistrust the justice system, and not just in the US. I had no idea about the level of poverty that poor Americans face. What my pen pals have been through is totally beyond my experience.

We had very different backgrounds. His childhood [The executed inmate] was perhaps typical of many poor American families: they moved a lot, lived on the breadline, with violence in the neighbourhood; I was from rural Cambridgeshire with a large, happy family. I had my own home and a circle of friends. KC lived in a world of aggression, uncertainty and disruption, a world of shakedowns and lockdowns.

Does the death penalty help with overpopulation of prisons?

Capital punishment can deal with overpopulated prisons in the United States. It can also increase the difficulties for the guards to control the extra amount of inmates. California prisons were ordered by district court panel to release or transfer more than 33,000 inmates due to overcrowding in 2011 (CNN.com).

Does The Death Penalty Bring Closure To The Victims Family? – chetumenu.com (archive.ph)

Closure and its myths: Victims’ families, the death penalty, and the closure argument – Judy Eaton, Tony Christensen, 2014 (sagepub.com)

Retribution has its basis in religious values, which have historically maintained that it is proper to take an “eye for an eye” and a life for a life. Although the victim and the victim’s family cannot be restored to the status which preceded the murder, at least an execution brings closure to the murderer’s crime and closure to the ordeal for the victim’s family and ensures that the murderer will create no more victims. For the most cruel and heinous crimes, the ones for which the death penalty is applied, offenders deserve the worst punishment under our system of law, and that is the death penalty. Any lesser punishment would undermine the value society places on protecting lives. Robert Macy, District Attorney of Oklahoma City, described his concept of the need for retribution in one case: “In , a young mother was rendered helpless and made to watch as her baby was executed. The mother was then mutilated and killed. The killer should not lie in some prison with three meals a day, clean sheets, cable TV, family visits and endless appeals.

When the Department of Justice announced its intention to resume federal executions after a 17-year hiatus, Barr declared that “we owe it to the victims and their families to carry forward the sentence imposed by our justice system.” Yet, Bandes explains, earlier in his career, Barr had cited deterrence and retribution as his reasons for supporting the death penalty. “Barr’s shift mirrored a subtle but powerful change in the national conversation about capital punishment,” she says. “As the deterrence rationale proved hard to justify, and the retributive rationale began to sound too angry and vengeful, both have been replaced with a kinder, gentler-sounding justification: by carrying out executions we can honor the victims and help their families heal.”

Despite its popularity as a justification for the death penalty, closure has no basis in psychological research, Bandes says, and there is no evidence that executions provide relief to victims’ families. In fact, research has shown that families often feel re-victimized when an execution does not bring about the closure they had hoped for.

“Most of the staff was young … in our 20s and early 30s … and we really didn’t know what to do,” Allen tells us. “I mean, we had received execution orders before, but hadn’t carried them out until now.”

Smith’s execution was scheduled for 8 a.m., which turned out to be a “huge mistake,” because “there were so many protests and all of the TV stations from Atlanta were down there reporting.”

For the next few years, Allen tried not to let his personal feelings get involved as he interacted with death row inmates. He never tried to think about their innocence or guilt, but he says those years were extremely confusing and he eventually developed internal “emotional issues” as well as a heavy drinking problem.

“I tried to be professional, but some officers didn’t do that or didn’t care,” he says. “When we executed John Eldon Smith, I remember one of the officers singing Annie’s ‘Tomorrow’ song, but changing the lyrics to ‘We’re going to burn John Smith tomorrow.’”

“The coldness stuck with me throughout the years. The state had a psychologist talk to the inmates, but the staff didn’t have anyone to talk to. They didn’t think it was an issue and I still hold a grudge against them for that.”

“He was making peace with God, with life,” said Allen. “I went to release my hand and he just squeezed harder.”

If the death penalty can help survivors heal, then retribution can be
viewed as therapy rather than bloodlust.

Victims, “Closure”, and the Sociology of Emotion (uchicago.edu)

There is a limit to everything, what is dismembering the murderer would help the victims heal faster, if that was the goal.

Unfortunately, this therapeutic
promise has little to do with the actual workings of our capital system: it’s a poster child
for the dangers of engrafting the private language of emotion onto a complex,
hierarchical and coercive governmental entity.

Victims, “Closure”, and the Sociology of Emotion (uchicago.edu)

The modern justice system is set up so that victims have certain legal rights to protect them during legal proceedings and restore some sense of stability into their lives. Most of us today recognize this as a basic concept of justice, but it wasn’t always that way. In the 1970s, victims’ rights had become so ignored that people started protesting and demanding change. We call this the Victims’ Rights Movement.

“There is no doubt that this panic-stricken little girl experienced a level of terror that no child or no one should ever have to endure,” she said.

In an October court hearing, Kenneth Crowell called Joseph “an absolute evil person in its purest form” for committing the murders of his daughter and granddaughter. “You are no different than something like an infectious disease,” he said. “You should be banished from this earth. That way, no one else can be affected.”

Justices, who in the last year have been criticized for dismantling what death-penalty opponents said were key protections that prevented innocent people from being executed, quizzed Giger about whether Joseph’s crime satisfied Florida’s requirements for the death penalty.

Giger said the murders of both Crowell and her daughter fit the criteria. But, she said, Joseph had time to think before he shot Kyra. His brother tackled him, trying to stop him, but still Joseph continued to pursue the fifth-grader.

“When you have this kind of premeditation directed at an 11-year-old child, I think it gets over it,” Giger said.

Unfortunately many guidance counselors in schools today have only 1 job, place kids in colleges so the school or school board can say “90+% of our kids go to college”.

Never mind the fact that college isn’t for everyone, never mind that many kids who should go to college would be better off waiting a couple of years to do so and never mind that the kids who are going to go to college at 18 rarely need a guidance counselor to figure out how to do so (their parents will do that).

A truer statement can never be made. Folks need a license to drive a car. They need a license to fish and to hunt. They need a license to legally marry. But, for some reason, giving birth to another human being, is verboten to discuss, to question, to reasonably object. We shy away from the most important duty any adult is given.

David gets so desperate for food that he resorts to stealing food from his classmates’ lunches when he’s in first grade. His classmates soon catch on and tell the teacher, who reports it to the principal, who calls David’s mother. It becomes a vicious cycle: David steals food, gets in trouble, is punished by getting less food at home, and becomes even more desperate to find something to eat. Withholding food as punishment leads to actions that result in more punishment of this type.
